Thank you for using the Lovart.AI Platform (the “Services”). These Terms of Service (the “Agreement”) explain your rights regarding images and other assets you may generate through the Services (the “Assets”) and your use of the Services. Please read carefully. Our Privacy Policy explains how we handle your data.

This Agreement applies to all users of the Lovart.AI website and software (referred to as “Customer,” “You,” or “Your”) and constitutes a binding agreement with Lovart.AI.

By creating an account or using the Services, you accept these terms. If you do not agree, do not use the Services and delete your account if applicable.

1. Lovart.AI Accounts and Provided Services

1.1 Account Requirements

A registered account is required to use image generation and posting functions.
You must provide accurate, complete, and up-to-date information.
You are responsible for keeping your account details current.

1.2 Age Requirements

You must be at least 13 years old and meet the digital consent age in your jurisdiction.
If underage, a parent or guardian must review and accept these terms on your behalf.
Parents/legal guardians are responsible for their child’s activity on the platform.

1.3 Account Security and Responsibility

You are solely responsible for:

Maintaining the confidentiality of your login credentials.
All activity occurring under your account.
Losses resulting from unauthorized access.

2. Intellectual Property Rights and Content Ownership

2.1 Ownership of Generated Content

You retain ownership of your inputs and the outputs generated (collectively, “Assets”), provided you comply with these Terms.

2.2 License Grant

You grant Lovart.AI a perpetual, irrevocable, worldwide, non-exclusive, transferable, royalty-free, sub-licensable license to use your Assets for any purpose, even after account termination.

“Use” includes: reproduction, modification, adaptation, distribution, public display/performance, and creating derivative works.

2.3 Waiver of Moral Rights

Where allowed by law, you waive moral rights to the Assets. Where not permitted, you agree not to enforce those rights against Lovart.AI.

2.4 Third-Party Rights

You confirm that your use of the Services does not infringe on any third-party intellectual property rights.

3. User Conduct and Prohibited Activities

3.1 Acceptable Use

You agree not to use the Services to:

Violate any law or regulation
Harm or exploit minors
Spread false or harmful information
Share personally identifiable information maliciously
Harass, defame, or abuse others
Engage in automated decisions that negatively affect others’ rights
Discriminate or exploit vulnerable individuals
Provide medical advice or generate legal/judicial materials

3.2 Prohibited Content

You must not use the Services to upload or generate content that is:

Defamatory, obscene, pornographic, hateful, or inflammatory
Encouraging criminal behavior or violence
Threatening or discriminatory based on protected characteristics
Trolling or intended to provoke

3.3 Technical Restrictions

Do not:

Reverse engineer, decompile, or modify the Services
Remove copyright/trademark notices
Sell, license, or redistribute the Services
Use bots or scripts to scrape or automate actions
Upload malware or bypass security mechanisms

4. Content Generation and AI Model Limitations

4.1 Unpredictable Behavior

Generated outputs may be unexpected, non-unique, or inconsistent with your inputs. Outputs may be similar across users.

4.2 No Guarantees

Lovart.AI does not warrant the accuracy, originality, or suitability of generated content. You are solely responsible for evaluating and using it.

5. Termination

5.1 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for reasons including (but not limited to):

Breach of these Terms
Activities that cause harm to us or others
Law enforcement requests
Technical/security issues
Prolonged inactivity

5.2 Effect of Termination

Account termination may result in loss of access to your data.
We are not responsible for retaining or recovering your content—please back up regularly.

6. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.

Lovart.AI does not warrant that:

The Services will meet your expectations or requirements
Access will be secure or error-free
Generated content will be reliable or accurate
Availability will be continuous

We may suspend, modify, or discontinue any portion of the Services at any time without notice.

7. Limitation of Liability

To the maximum extent permitted by law:

Lovart.AI is not liable for indirect, incidental, special, consequential, or punitive damages
Our maximum liability is limited to the greater of USD $50 or the amount you paid to us in the past 12 months

8. Indemnification

You agree to indemnify and hold harmless Lovart.AI, its affiliates, and personnel from any claims or liabilities resulting from your use of the Services or violation of these Terms.

9. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to the collection and use of your data as described.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

11. Miscellaneous

11.1 Entire Agreement

These Terms constitute the full agreement between you and Lovart.AI.

11.2 Severability

If any part of this Agreement is found unenforceable, the rest remains in effect.

11.3 No Waiver

Failure to enforce a provision does not waive our right to enforce it later.

11.4 Security

We do not guarantee the Services are virus-free. Use appropriate security and virus protection measures on your systems.
